A federal judge in New York ordered the city of New York to pay $2.1 million to settle a lawsuit by people who allegedly stole Viagra pills. That suit was brought by New York State Attorney General George E. Gonzalez, Jr.
The federal court ordered the city of New York to pay the $2.1 million in civil settlement funds to help pay for the alleged fraudulent practices by Pfizer Inc., the pharmaceutical manufacturer, in the state of New York.
The $2.1 million was part of a settlement fund the city of New York agreed to fund by the end of the year to help the government in resolving the alleged fraud.
The case was brought by New York State Attorney General Gonzalez, Jr. and New York State District Attorney Frank R. Kennedy.
“Our work to bring this case to a conclusion is far beyond what the law enforcement agency can reasonably expect,” said Gonzalez, who is a partner in the pharmaceutical litigation division of the firm P& J. “This is the first time in history that a federal judge has ordered any money that will help pay for a criminal investigation that will lead to a settlement of a criminal charge against Pfizer.”
Pfizer filed the suit in 2009 after U. S. District Judge John D. LeMay ruled that the company had failed to show that Viagra was ever made to a person or entity. The company also failed to prove that the person was involved in the illegal conduct. The case was stayed pending a trial in 2012 in the U. District Court for the District of New Jersey.
The case was brought in federal court to the U. District Court for the District of New Jersey by New York State Attorney General George Gonzalez, Jr.
The judge granted Pfizer’s motion for a temporary restraining order, saying the case was not in the best interests of the plaintiff. Pfizer was ordered to pay $100,000 to the defendant, the state of New York.
“The court’s ruling is consistent with the court’s previous orders of the United States District Judge for the Northern District of Florida. The court has also been consistent in its decision. The court will continue to monitor the matter and will make updates regarding the matter.”
The order of the judge will be in place until the end of the year, and the case is being investigated by the government and the state of New York.
Pfizer said it will appeal the decision in all cases.
“This case is a perfect example of how important our work is to the public,” said Dr. Robert G. Sondin, a professor of criminal law at the University of Michigan School of Law. “The court’s decision means that the United States may not be able to bring about a successful criminal investigation, and the United States can still pursue other criminal investigations if Pfizer is held liable for a civil conspiracy involving a civil wrong.”
